AN ORDER ADOPTING EXECUTIVE ORDER NO. 28, SERIES OF 2020 ISSUED BY THE HONORABLE GOVERNOR OF THE PROVINCE OF BULACAN DANIEL R. FERNANDO AND PROVIDING THE COMPREHENSIVE COVID-19 COMMUNITY QUARANTINE GUIDELINES IN THE MUNICIPALITY OF PULILAN UNDER THE GENERAL COMMUNITY QUARANTINE (GCQ) FROM AUGUST 19 UNTIL AUGUST 31, 2020
WHEREAS, Article II, Section 15 of the Philippine Constitution provides that the State shall protect and promote the right to health of the people and instill health consciousness among them;
WHEREAS, on 17 August 2020, President Rodrigo Roa Duterte placed Metro Manila to General Community Quarantine (GCQ) from August 19 until August 31, 2020, likewise reverted the provinces of Bulacan, Cavite, Laguna and Rizal from Modified Enhanced Community Quarantine (MECQ) to GCQ;
WHEREAS, for its adoption in the Province of Bulacan, Hon. Daniel R. Fernando, Provincial Governor issued Executive Order No. 28, Series of 2020 dated 18 August 2020;
WHEREAS, in the said EO, strict implementation of the NIATF-EID’s Omnibus Guidelines on the Implementation of Community Quarantine in the Philippines with Amendments as of July 16, 2020 and other related issuances shall be enforced;
WHEREAS, there is a need to issue an order providing local comprehensive guidelines to assist in the transition of the Municipality of Pulilan, Bulacan from MECQ to GCQ;
NOW THEREFORE, I, MARIA ROSARIO OCHOA-MONTEJO, Municipal Mayor of Pulilan, Bulacan, by virtue of the powers vested in me by law, do hereby order the following:
SECTION 1. TITLE. This Order shall be known as An Order Adopting Executive Order No. 28, Series of 2020 issued by the Honorable Governor of the Province of Bulacan Daniel R. Fernando and Providing the Comprehensive COVID-19 Community Quarantine Guidelines in the Municipality of Pulilan under the General Community Quarantine (GCQ) from August 19 until August 31, 2020.
SECTION 2. ADOPTING THE IATF OMNIBUS GUIDELINES ON GENERAL COMMUNITY QUARANTINE AND OTHER RELATED ISSUANCES. The Municipality of Pulilan will adopt and adhere to the Guidelines on Community Quarantine as prescribed by the National Inter-Agency Task Force for the Management of Emerging Infectious Diseases (NIATF-EID), Regional Inter-Agency Task Force for the Management of Emerging Infectious Diseases (RIATF-EID), and other related issuances with emphasis on the following provisions:
1. Minimum public health standards shall be complied with at all times for the entire duration of the GCQ.
2. All LGUs within the province are directed to observe the strict enforcement of the following measures:
a. Implementation of localized community quarantines in identified barangays with community transmission, with the concurrence of the Regional Inter-Agency Task-Force (RIATF);
b. Minimum public health standards, especially in high-risk areas such as healthcare settings, wet markets, supermarkets, government offices, workplaces, public transportation, and areas with increased economic activity, among others and
c. Active surveillance and case handling;
d. All confirmed cases of COVID-19 shall be quarantined in facilities identified and exclusively dedicated for the purpose. No home quarantine for them shall be allowed.
3. A localized community quarantine shall be categorized into four (4) zoning classifications:
a. Critical Zone (CRZ) is an area where the initial number of cases or several clustering of cases are identified within the past seven (7) days. Specific epidemiological parameters with epidemiological threshold for CRZ are set depending on the geographical unit
b. Containment Zone (CZ) are areas without new cases but are adjacent
c. Buffer Zone (BZ) are areas without new cases but are adjacent to
d. Areas Outside Buffer Zones (OBZ) are all remaining areas without new to a geographical unit categorized as CRZ; areas categorized as CZ, and cases not categorized as CZ or BZ;
4. The travel and movement of all persons in the province shall be limited to accessing essential goods and services, and for work in offices or industries permitted to operate hereunder. Travel and movement for leisure purposes shall not be allowed.
5. Any person twenty (20) years old and below, those who are sixty (60) years old and above, those with immunodeficiency, comorbidity, or other health risks, and pregnant women shall remain in their residences at all times, except when outside travel is indispensable for obtaining essential goods and services, or for work in permitted offices and industries.
6. Work in all government offices may be at full operational capacity or under such alternative work arrangements as the agencies may deem proper, in accordance with the relevant rules and regulations issued by the Civil Service Commission (CSC) and/or the Department of the Interior and Local Government (DILG); provided, that for offices requiring employees to report physically, commissioned shuttle services as well as point-to-point transport services may be provided.
7. By category, the following sectors or industries are allowed to operate at an operational capacity as provided herein:
a. Category I industries. Power, energy, water, and other utilities, agriculture, fishery, and forestry industries, food manufacturing and food supply chain businesses, including food retail establishments such as supermarkets, grocery stores, and food preparation establishments insofar as take-out and delivery services, food delivery services, health-related establishments, the logistics sector, information technology and telecommunication companies, the media, at full operational capacity,
b. Category II Industries. Mining and other manufacturing, and electronic commerce companies, as well as other delivery, repair and maintenance, and housing and office services, at anywhere between fifty percent (50%) up to full operational capacity, and without prejudice to work-from-home and other alternative work arrangements; and
c. Category III industries. Financial services, legal and accounting, and auditing services, professional, scientific, technical, and other non-leisure services, and from skeleton workforce to fifty percent (50%) operational capacity, and without prejudice to non-leisure wholesale and retail establishments, other work-from-home and other alternative work arrangements.
The holding of traditional cockfighting and operation of cockpits, and the operation of beerhouses and similar establishments whose primary business is serving of alcoholic drinks (e.g. nightclubs) and kid amusement industries (e.g., playrooms, rides) is prohibited. (lbid.)
The foregoing list of industries is illustrative only. Specific industries under each category may be reflected in separate issuances of the Department of Trade and Industry (DTI), which likewise provides for operational and venue capacity, operating hours, and other guidelines, provided, that this is without prejudice to the subsequent re-categorization of Category IV Industries. 8. Limited operations in malls and shopping centers shall be allowed, except for leisure establishments and services which shall continue to be closed; provided that establishments and services allowed to operate in malls and shopping centers may only operate at a capacity consistent with the Omnibus Guidelines and policies set down by the DTI; provided further, that those twenty (20) years old and below, and those sixty (60) years old and above, and those with immunodeficiency, comorbidity, or other health risks, and pregnant women may not enter malls and shopping centers except when indispensable to obtain essential goods and services, or for work in establishments located therein; provided finally, that operations of malls and shopping centers are subject to the guidelines issued by the IATF and DTI.
9. All public and private construction projects shall be allowed, but with strict compliance with all construction safety guidelines issued by the Department of Public Works and Transportation (DPWH) for the implementation of infrastructure projects during the period of the pandemic.
10. All Category V Industries shall not operate. The DTI, in consultation with the Department of Finance (DOF), DILG, and the Department of Tourism (DOT), may re-categorize industries as may be deemed necessary and which re categorization(s) shall automatically form part of this Executive Order.
11. The resumption of, or gradual increase in operating capacity, and continued operations of Category III Industries shall be subject to their proprietors’ compliance with the proper health protocols set by the DTI. Further, their compliance shall be assessed through a post-audit mechanism which shall be led by the DTI, Department of Health (DOH). LGU health offices, and/or other deputized organizations. 12. No hotel or accommodation establishment shall be allowed to operate, except those accommodating the following
a. Guests who have existing booking accommodations for foreigners as of 17 March 2020;
b. Guests who have existing long-term bookings;
c. Distressed OFWs and stranded Filipinos or foreign nationals,
d. Repatriated OFWs in compliance with approved quarantine protocols;
e. Non-OFWs who may be required to undergo mandatory facility-based quarantine; and
f. Healthcare workers and other employees from exempted establishments under the IATF Omnibus Guidelines and issuances of other government agencies.
They may operate only upon the issuance of a Certificate of Authority (CA) to operate by the DOT; provided, that in all of the foregoing, their operations shall be limited to the provision of basic accommodation services to guests through an in-house skeleton workforce. Ancillary establishments within the premises, such as bars, gyms, spas, and the like, shall not be allowed to operate or to provide room service. Restaurants and cafés therein are allowed to operate at an operating capacity to be determined by the LGU having Jurisdiction over them; provided, that it allows for social distancing measures and that Such establishments are compliant with the protocols prescribed by DOT, DTI, Department of Labor and Employment (DOLE), and DOH. 13. Restaurants and fast food businesses, barbershops and salons shall be allowed to operate at an operating capacity to be determined by the LGU having jurisdiction over them, and in all cases subject to the observance of the minimum health protocols.
14. The opening of schools shall be in accordance with the directive of the President upon the recommendation of the Department of Education (DepEd), pursuant to Republic Act 11480, and advise of the Commission on Higher Education (CHED). Face-to-face sessions or in-person classes shall be suspended. In the meantime, all instruction shall be delivered through the safest and most appropriate time and methods possible, as may be determined by the IATF, DepEd, CHED, DOH, and Technical Educational and Skills Development Authority (TESDA), whose applicable issuances shall be adopted.
15. Mass gatherings, such as but not limited to, movie screenings, concerts, sporting events, and other entertainment activities, community assemblies, and non- essential work gatherings, shall be prohibited. Gatherings that are for the provision of critical government services and authorized humanitarian activities, while adhering to the prescribed minimum health standards, shall be allowed. Religious gatherings shall be limited to not more than ten (10) persons at the venue; provided, that the gathering is limited to the conduct of religious worship and/or service only; provided further, that the LGU where the gathering is held or to be held interposes no objection thereto on grounds of safety and health protection; provided finally, that the participants in the gathering shall strictly observe the submitted health protocols of their religious group and the minimum public health standards such as physical distancing, wearing of facemasks, and immediate availability of sanitizers and other hygienic necessities.
16. Outdoor non-contact sports and other forms of exercise such as, but not limited to, walking, jogging, running, biking, golf, swimming, tennis, badminton, equestrian, range shooting, and skateboarding, are allowed; provided, that the minimum public health standards such as the wearing of masks and the maintenance of social distancing protocols, and non-sharing of equipment where applicable, are observed; provided further, that operations of the relevant clubhouses or similar establishments, if there are any, shall be limited to basic operations, and restaurants and cafés therein are allowed to operate at an operating capacity to be determined by the LGU having jurisdiction over them, provided that it allows for social distancing and are compliant with the proper protocols prescribed by the DTI. Spectators in all non-contact sports and exercises shall be prohibited. 17. Public utility vehicles (PUV) shall operate at a reduced operational and vehicle capacity in accordance with guidelines set by the Department of Transportation (DOTr), Land Transportation and Franchising Regulatory Board (LTFRB), and Concerned LGUs; provided, that in case of public utility buses or jeepneys, a one (1) meter distance between passengers shall be observed. In all cases, PUVs shall have the appropriate engineering controls in place to maintain such required distance and to prevent any close contact between and among the passengers and drivers/operators.
18. Visits to open-air memorial parks and cemeteries shall be limited to not more than ten (10) persons per group. The number of groups allowed at any given time shall be left to the discretion of the management of such memorial parks and cemeteries taking into consideration minimum public health standards and physical distancing. 19. In all of the permitted activities, industries, or venues mentioned above, the strict observance of the minimum health requirements shall be mandatory and indispensable.
20. As mandated by RA 11322, all public and private physicians, allied medical personnel, professional societies, hospitals, clinics, health facilities, laboratories, institutions, workplaces, schools, prisons, ports, airports, establishments, communities, other government agencies, and non-government organizations in the province are required to accurately and, within twenty-four (24) hours from discovery, report probable, suspected, or confirmed cases of COVID-19 within their areas of operation or jurisdiction to the appropriate Barangay Health Emergency Response Teams (BHERT), city/municipal health units, the Bulacan Provincial Health Office, and the Regional Epidemiological Surveillance Unit (RESU) in Pampanga, as is necessary or appropriate.
Considering the high incidence of COVID-19 transmission in workplaces, all employers, companies, and establishments based or with offices, branches, or operations in the province engaging employees, workers, staff, or personnel under whatever contract or working status are strictly enjoined to report such cases as directed above and to comply with the conditions set by the DTI.
All persons who are probable, suspected, or confirmed COVID-19 cases shall not be allowed to leave the premises where they are found nor allowed to return to their homes. Instead, they will be immediately isolated and confined at the dedicated facilities of these establishments, where available, and turned over to the concerned BHERT or cÃty/municipal health offices as soon as possible for appropriate action.
21. The curfew hours in the entire province shall be from 8 p.m. until 5 a.m. of the next day, during which period no person shall be allowed outside of residence, except those in need of emergency services and those allowed to work in permitted industries; provided, that the latter must provide authorities sufficient proof of their work schedules.
SECTION 3. COMPLIANCE. All residents and establishments within the Municipality of Pulilan are hereby directed to strictly comply with the regulations and guidelines stated in this Order.
SECTION 4. EFFECTIVITY.This Executive Order shall take effect immediately upon signing and will remain in effect unless otherwise revoked.
