AN ORDER ADOPTING PROVINCIAL ORDINANCE NO. 87-2020: AN ORDINANCE IMPOSING A PROVINCE-WIDE CURFEW AND RECQUIRING QUARANTINE PASSES OUTSIDE RESIDENCE AND FOR OTHER PURPOSES DURING COMMUNITY QUARANTINE AND PROVIDING FOR PENALTIES THEREFOR IN THE MUNICIPALITY OF PULILAN

WHEREAS, Article II, Section 15 of the Philippine Constitution provides that the State shall protect and promote the right to health of the people and instill health consciousness among them;

WHEREAS, Bulacan, together with Metro Manila and key provinces, been placed on August 4, 2020 under Modified Enhanced Community Quarantine (MECQ) chiefly to arrest the continuous rise in Coronavirus Disease (COVID-19) infections; to prevent the collapse of the health care system and for the government to craft a more effective response against the pandemic;

WHEREAS, in view of the uncertainty of the COVID-19 situation in the country and the varying implementation of the Community Quarantine regulations, uniform rules are necessary in the Province of Bulacan;

WHEREAS, the Provincial Government of Bulacan is dedicated to protect the safety and public health of every Bulakenyo and is committed in restoring the original economic and socio-economic landscape of the province;

WHEREAS, science and empirical data suggests that limiting the time spent outside residence into an hour for each individual is a great contribution in containing the virus;

WHEREAS, in times of calamities and disasters calls for the exercise of the police power of the state in order to address the peculiar nature of the pandemic;

WHEREAS, that under the General Welfare Clause of Section 16 of Republic Act (R.A.) 7160, empowers every local government unit to exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare;

WHEREAS, there is a need to adopt Provincial Ordinance No. 87-2020: An Ordinance Imposing a Province-Wide Curfew and Requiring Quarantine Passes Outside Residence and for Other Purposes during Community Quarantine and Providing for Penalties Therefor to adhere to the Provincial Directives and provide additional guidelines to secure the health and safety of our constituents;

NOW THEREFORE, I, MARIA ROSARIO OCHOA-MONTEJO, Municipal Mayor of Pulilan, Bulacan, by virtue of the powers vested in me by law, do hereby order the following:

SECTION 1. ADOPTION. The Municipality of Pulilan, Bulacan shall adopt Provincial Ordinance No. 87-2020: An Ordinance Imposing a Province-Wide Curfew and Requiring Quarantine Passes Outside Residence and for Other Purposes during Community Quarantine and Providing for Penalties Therefor, particular to the following provisions:

1. Quarantine Pass – the quarantine pass must bear the seal of the duly authorized government authority or shall contain such other features necessary for its authenticity. The quarantine pass shall also bear the photograph of the individual to whose favour it is issued. In the absence of the photograph, a valid identification or a Barangay certification shall be presented together with the quarantine pass. The quarantine pass once issued shall be effective anywhere in Bulacan unless otherwise provided by the IATF guidelines

No quarantine pass shall be issued to any person below 21 years old or any person above 59 years old. All quarantine pass issued at the time prior to the effectivity of this ordinance shall be recalled and another one shall be issued to a qualified member of the household.

A quarantine pass may be excused in case of emergency or life threatening situations if such is intent.

Public Utility Jeepneys (PUJs) are prohibited to operate except if are hired as personal service of government employees or employees engaged in the business allowed by the IATF guidelines.

Tricycle operation depends on the local government concerned within their area of operation.

The quarantine pass outside residence shall only be required when the Province of Bulacan is placed under ECQ and MECQ unless otherwise provided for under the IATF Guidelines.

2. Single Individual per Household Policy – no person other than the designated individual by the household bearing the quarantine pass or the APOR bearing the necessary documents shall be allowed to go outside of their homes for the purpose for which it was issued.

In the case of Authorized Persons Outside Residence (APOR), they shall be allowed to go outside from home to work and in order to render their services upon presentation of, but not limited to the following:

• Company issued Identification Card
• Contract of employment
• Other necessary documents or those that may be imposed by existing national guidelines as the case may be.

Every establishment shall post a notice to the public that no transaction shall be entertained unless a quarantine pass or the necessary document is presented as the case may be.

3. Who may issue Quarantine Pass – without prejudice to the provisions of IATF Guidelines and other similar issuances, the quarantine pass maybe issued by the following:

a. The Governor with respect to his personnel and security, provincial government heads and employees;
b. The Vice-Governor with respect to his personnel and security as well as to the Office of the Secretary of the Sangguniang Panlalawigan employees;
c. The Board Members to their respective staff, personnel and security;
d. The Mayor with respect to his personnel and security, the councilor’s staff as well as to the city or municipal government department heads and employees;
e. The Barangay Captain to its constituents in the Barangay who are not an APOR.

4. Provincial Wide Uniform Curfew – curfew shall be strictly imposed when:

a. In case of Enhanced Community Quarantine (ECQ), Modified Enhanced Community Quarantine (MECQ) or General Community Quarantine (GCQ) from 8 o’clock in the evening to 5 o’clock in the morning (8PM-5AM);
b. In case of Modified General Community Quarantine (MGCQ) from 11 o’clock in the evening to 4 o’clock in the morning (11PM-4AM).

However, the curfew shall not extend to those APOR, or employees working outside Bulacan and by the nature of their work, are required to work during the specified hours, provided that he/she presents a proof of work and identification.

SECTION 2. PROHIBITED ACTS. The following acts shall be prohibited:

a. Going outside the household without the required quarantine pass or without the necessary document as the case may be;
b. Tampering or counterfeiting of the quarantine pass making it appear to be issued by the duly authorized government agency by means of erasing, substituting, counterfeiting or altering by any means the figures, letters, words or signs contained therein;
c. Borrowing or loaning the quarantine pass in order to circumvent the provision of this ordinance;
d. Establishment that allows the entry to its premises of any person other than the designated individual or an APOR;
e. Preventing an APOR from going to work despite the presentation of the necessary documents;
f. Unless the household or Barangay is on lockdown, preventing any person from going out of their home in order to buy food medicine and other necessary documents as the case maybe; and
g. In case of a public officer, the issuances of additional quarantine pass in order to circumvent the provision of this Ordinance

SECTION 3. PENALTIES. Any individual in violation of the above mentioned provisions shall be apprehended accordingly.

SECTION 4. EFFECTIVITY.This Executive Order shall take effect immediately upon signing and will remain in effect unless otherwise revoked.
